General Terms & Conditions – Runaway Travels

1.Introduction

1.1 These General Terms & Conditions (“Terms”) govern the legal relationship between you (“Customer” or “User”) and Runaway Travels Limited (“Runaway Travels,” “we,” “us,” or “our”), a New Zealand-based online travel agency. 1.2 By accessing or utilizing our flight booking services through our runaway.co.nz or mobile application (“Platform”), you acknowledge that you have read, understood, and agreed to be bound by these Terms. 1.3 If you do not accept these Terms in full, you must refrain from using our Platform and related services.

2.Booking & Contractual Relationship

2.1 Runaway Travels operates as an intermediary between Users and airlines, facilitating the purchase of flight tickets. We do not own, manage, or control airline services. 2.2 Your purchase of a flight ticket constitutes a separate contract between you and the airline, subject to the airline’s specific terms and conditions, which you must review before booking. 2.3 All bookings are final upon payment and issuance of an electronic ticket. Any subsequent changes, cancellations, or modifications are governed by airline policies and applicable laws.

3.Prices, Fees & Payment Terms

3.1 Prices displayed on our Platform are dynamic and subject to fluctuation based on airline pricing models, availability, and seasonal demand. 3.2 Payments must be made using accepted methods, including credit cards, debit cards, and authorized third-party payment gateways. Runaway Travels reserves the right to impose payment processing fees where applicable. 3.3 Users acknowledge that additional surcharges, government taxes, and service fees may be applied to the final booking cost. 3.4 In the event of payment disputes, chargebacks, or unauthorized transactions, Runaway Travels reserves the right to take legal action to recover any outstanding amounts.

4.Cancellations, Modifications & Refunds

4.1 The cancellation and modification of flight bookings are subject to airline policies, fare rules, and applicable laws. 4.2 Runaway Travels shall not be liable for any financial loss, inconvenience, or penalties arising from airline-imposed restrictions on cancellations and changes. 4.3 Refund requests are subject to the terms of the airline and may incur processing fees. The refund processing time is dependent upon airline procedures, and Runaway Travels cannot guarantee a specific timeframe for reimbursement. 4.4 If a flight is cancelled, rescheduled, or disrupted due to force majeure events (e.g., natural disasters, terrorism, government travel restrictions, pandemic-related policies), the airline’s liability shall govern any reimbursement or compensation claims.

5.Travel Documentation & Compliance

5.1 Users are solely responsible for ensuring that they possess valid travel documentation, including passports, visas, transit permits, and any required vaccinations. 5.2 Runaway Travels assumes no responsibility for denied boarding, deportation, fines, or other penalties resulting from non-compliance with entry requirements imposed by immigration authorities. 5.3 Travelers are advised to review visa and entry regulations for their intended destinations before finalizing their booking.

6.Limitation of Liability

6.1 No Warranty Disclaimer: To the maximum extent permitted by law, Runaway Travels provides flight booking services “as is” without warranties of any kind, express or implied, including but not limited to accuracy, uninterrupted service, and availability. 6.2 Runaway Travels shall not be held liable for any indirect, incidental, consequential, or special damages arising from the use of our Platform, including but not limited to financial loss, missed flights, or disrupted travel plans. 6.3 Users waive any claims against Runaway Travels for losses resulting from airline delays, cancellations, strikes, operational failures, or air traffic disruptions.

7.Privacy & Data Protection

7.1 Runaway Travels collects and processes personal data in accordance with the New Zealand Privacy Act 2020 and applicable international data protection laws. 7.2 Users agree that their personal information may be used for flight booking, customer support, fraud prevention, and marketing activities. 7.3 Runaway Travels will not sell or distribute customer data to third parties without explicit consent, except where required by law or regulatory authorities.

8.Intellectual Property Rights

8.1 All intellectual property rights, including trademarks, copyrights, and proprietary content displayed on the Platform, are owned by Runaway Travels or its licensors. 8.2 Users shall not reproduce, distribute, or commercially exploit any content from the Platform without prior written authorization from Runaway Travels.

9.Governing Law & Dispute Resolution

9.1 These Terms are governed by the laws of New Zealand, including but not limited to the Fair Trading Act 1986 and Consumer Guarantees Act 1993. 9.2 Dispute Resolution Mechanisms: Any disputes arising from the use of Runaway Travels’ services shall be resolved through mediation or arbitration before litigation. 9.3 In cases where legal action is required, the courts of Auckland, New Zealand shall have exclusive jurisdiction.

10.Force Majeure Clause

10.1 Runaway Travels shall not be held liable for service interruptions due to force majeure events, including but not limited to natural disasters, governmental regulations, labor strikes, war, terrorism, pandemics, or airline operational failures. 10.2 Users acknowledge that refunds or compensation resulting from such events are subject to airline policies.

11.Security & Fraud Prevention

11.1 Users agree to use the Platform for lawful purposes and shall not engage in fraudulent or unauthorized transactions. 11.2 Runaway Travels reserves the right to terminate accounts, cancel bookings, and take legal action against users suspected of fraud or abuse.

12.Severability Clause

12.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.

13.Assignment Clause

13.1 Runaway Travels may assign or transfer its rights and obligations under these Terms to any affiliate or successor entity without prior notice.

14.Amendments & Updates

14.1 Runaway Travels reserves the right to modify or amend these Terms at any time without prior notice. 14.2 Users are encouraged to review these Terms periodically, as continued use of our services implies acceptance of any revisions.
